All the content on this site, including text, graphics, logos, icons, designs, colors, layout and trademarks are the intellectual property of African Diurnal Safaris & Tours and its affiliates. It is safeguarded under both Tanzanian and international intellectual property laws.

 

Contract

Your contract is with African Diurnal Safaris. We draw your attention to the following terms and conditions, which cover all brochures and correspondence and all bookings made with us. Any contract with African Diurnal Safaris is subject to these terms and conditions from which no person has the authority to depart.

Before making a booking with us you must ensure that you have read and understood these booking conditions (raising any queries you may have with us). By asking us to confirm your booking you are liable to be regarded as having had the opportunity to do so and to have actually done so before the contract between us comes into existence.

 

Privacy

African Diurnal Safaris will keep all personal information you give us as strictly confidential and no personal information will be made available to third parties, unless obliged to do so by law or legal process. When you forward personal information including your name, e-mail address, mailing address and credit card details to us, African Diurnal Safaris will use a secure server to encrypt such information before it is received by us.

Once we receive it, we will protect such information from unauthorized access and use. This site may use cookies to customize it and make your visit to us more users friendly. Cookies cannot harm your computer in any way and are an industry standard. They are small text files that contain only information provided by you, the visitor, to the website.

Furthermore, our users may configure their browsers to not accept our cookies. African Diurnal Safaris may send e-mail messages to our customers with news and special offers and users may, by return mail, indicate whether they would prefer not to receive any such mail in future.

 

Booking Procedure

African Diurnal Safaris will create a tailor made holiday to suit your personal needs. A binding contract comes into existence between us when:

  • We require a 30% deposit based on the quoted price, or
  • Full payment for the holiday is required at the time of booking if it is made less than 45 days before the departure date.

No contract will exist between the parties until such monies have been received. We require full payment to be made for your holiday 45 days prior to the departure date. If full payment is not received 45 days prior to the departure date, we reserve the right to cancel your holiday and apply the cancellation charges set out on followed paragraph below.

If cancellation occurs, it will be without penalty on our part, and we will bear no further responsibility toward you. However, if you have already provided us with your credit or debit card detailswhether for an advance payment or otherwise—and you do not explicitly inform us in writing before the due date for any outstanding balance, you agree that we may use those card details to process the payment of any balance owed under this agreement.

The lead booking name is liable for making full payment for all persons in the booking party and all those in the booking party agree to be bound by conditions (including anyone added or substituted at a later stage). It is the responsibility of the lead booking name responsible for making the booking to ensure all in their party are aware of and have read these terms and conditions. If you accept our quote in respect of your holiday you must make a payment of 30% of the total price of the quote when you confirm your trip with us in writing. Delays in accepting the quote could lead to changes in the holiday price. If the proposed departure date falls within 45 days of the quote being issued, full payment will be required at the time you provide written confirmation of acceptance.

All bank charges and online payment surcharges must be covered by the client or agent, as applicable. This includes any transaction fees charged by our bank. The invoice amount reflects the exact sum that must appear in our account. If any bank charges are deducted, we will need to issue a subsequent invoice to recover the difference.

 

Pricing Itineraries

The price of your itinerary will be based on known costs at the date of issue of the itinerary. At any time before a full payment of your holiday has been made, African Diurnal Safaris reserves the right to levy a surcharge where costs have changed since the date of issue of the itinerary. We will absorb amounts up to 2% of the total holiday price and surcharge any amount greater than 2%. Should the surcharge exceed 10% of the total holiday price before 60 days of arrival date you are entitled to cancel the holiday and receive a full refund of all monies paid?

We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.
Matters influencing a surcharge would include, but are not limited to, increases in transportation costs e.g. fuel, scheduled air fares and any other airline surcharges, taxes or fees payable for services such as landing taxes, or embarkation or disembarkation fees at ports or airports, or increases in park fees, reserve fees or concession fees.

 

Medical Conditions and Disabilities

If you or any member of your party have any medical problem or disability which may affect your holiday, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking. If we genuinely believe that we are unable to adequately address the specific needs of the individual in question, we reserve the right to refuse the booking or, if complete details were not provided at the time of booking, to cancel it upon becoming aware of such information.

 

Documentation

Carefully review your confirmation invoice, tickets, and any other documents we send you as soon as they arrive. Contact us immediately if any information appears to be incorrect as it may not be possible to make changes later. We regret we cannot accept any liability if we are not notified of any inaccuracy in any documentation within 7 days of our sending it out.

You will be responsible for any costs and expenses involved in rectifying any inaccuracies except where we made the mistake.

 

Cancellations, Amendments and No shows

Cancellation of a holiday, notice must be provided in writing and will take effect from the date the written notification is received. In every case of cancellation, both the deposit and any amendment fees are non-refundable.

  • For cancellations made more than 8 weeks before departure, the full 30% deposit will be forfeited.
  • If the cancellation occurs between 8 and 4 weeks prior to travel, 50% of the total cost will be forfeited.
  • For cancellations made less than 4 weeks before travel, 100% of the total cost will be forfeited.

 

Cancellation by Us

We retain the right to cancel your holiday under any circumstances and at any time prior to receiving full payment. Please note that we cannot be held responsible or provide compensation if the fulfillment of our contractual obligations is hindered or impacted, or if you experience any loss or damage due to events categorized as force majeure.

In these booking conditions force majeure means any event which we or the supplier of services in question could not even with all due care foresee or avoid.
Such events are likely to include war, threat of war, civil strife, riot, civil disorder/unrest, industrial dispute, actual or threat of terrorist activity, natural or nuclear disaster, fire, breakout of an epidemic or pandemic disease, technical problems with transport, cancelation or amendment to any scheduled flight, closure, congestion of airports or ports, adverse weather conditions and all similar events outside our control. In the circumstances amounting to force majeure we will not refund any money to you although if we can recover any monies from our suppliers we will refund these to you.

 

Amendments by You

If you need to modify your itinerary after making a deposit, we will make every effort to accommodate your request, as long as we receive written notification. Please note that each change may incur a fee based on the adjustments required.

 

Amendments by Us

It is unlikely that we will have to make any changes to your holiday although we reserve the right to make changes at any time. Most of these changes are minor and we will advise you of these in writing at the earliest possible date. When a major change is necessary such as the alteration of your outward or return flights by more than 12 hours or a significant change in the standard of accommodation, provided it does not arise from conditions amounting to force majeure or as a result of an amendment to a scheduled airline timetable, you will have the choice of accepting the new arrangements, taking another holiday with us or cancelling your holiday and receiving a full refund of all monies paid.

Compensation will not be payable and no liability beyond offering the above mentioned choices can be accepted where we are forced to make a change or cancel as a result of unusual or unforeseen circumstances beyond our control, the consequences of which we could not have avoided even with all due care. No compensation will be payable and the above mentioned options will not be available if we cancel as a result of your failure to comply with any requirement of these booking conditions entitling us to cancel, or if the change is a minor one.

A minor change refers to an adjustment that, based on the information you provide at the time of booking or what we, as a tour operator, can reasonably anticipate, is unlikely to have a significant impact on your confirmed holiday. Compensation does not apply to children aged three and under. Please be aware that we cannot assume liability for any damage, loss, expense, other sums of any description, which:

  • On the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you, or
  • Did not result from any breach of contract or any other fault by ourselves or our employees, or where we are responsible for them our suppliers. Additionally we cannot accept liability for any sums which relate to any business losses.

 

Consent

By paying the deposit or any other partial amount for a reservation, you indicate your acceptance of all the Terms and Conditions. Any adjustments to these Terms for your reservation will only be valid if made in writing and signed by an authorized company representative.

 

Carriers

Carriage by air and sea is governed by the terms and conditions set forth by the carriers you are traveling with, as well as applicable international conventions. African Diurnal Safaris assumes no responsibility for cancellations, strikes, schedule changes, diversions, technical issues beyond our control, lost or misplaced luggage, rescheduling expenses, missed accommodations, or delays caused by the operational decisions of the respective carrier. Additionally, we do not accept liability for any death, injury, or illness arising from carriage by air or sea.

 

You’re Responsibility

Make sure your travel documents, including passports, visas, and vaccination certificates, are up-to-date and in order. It’s also important to follow your doctor‘s recommendations regarding necessary vaccinations. For further details, please refer to our pre-departure information sheet.

We provide general advice but cannot be held accountable if you fail to meet the current requirements before your departure. African Diurnal Safaris will not accept responsibility for any general guidance offered prior to the start of your holiday. It is your responsibility to ensure timely checkin for all flights and to be present for all pre-booked elements of your trip.

No credit or refund will be given to you should you fail to take up any component of your holiday or if you lose any travel documents. African Diurnal Safaris draws your attention to the fact that there are certain inherent risks involved in all of the holidays to Africa that we supply and these must be accepted by you at your own risk. If you wish to discuss any such risks with us we would be more than happy to provide advice over the telephone or in writing.

 

Baggage

Clients are responsible for their baggage and personal belongings at all times, as the Company cannot be held liable for any loss or damage to personal items, regardless of the circumstances. Each client is allowed one bag weighing no more than 15 kilograms (a backpack or soft bag, not a hard-shell suitcase) along with a daypack. The Company retains the right to decline any excess baggage. Please be aware that different baggage restrictions may apply on trekking tours or certain “bush” flights.

 

Insurance

We require clients to obtain travel insurance. Clients must ensure they secure comprehensive coverage, including protection for death, medical expenses, and evacuation, to safeguard against any potential losses or damages.

 

The law

The booking terms and conditions outlined above, along with all related correspondence, constitute your agreement with African Diurnal Safaris. This agreement, as well as any issues that may result from it, will be governed and interpreted under Tanzanian law. Furthermore, the courts of Tanzania shall hold exclusive jurisdiction to address any and all disputes between us, whether connected to or arising from this agreement.

 

Problems

If you encounter any issues during your holiday, promptly notify the appropriate organizer, such as the camp manager, hotel manager, or safari guide, who will make every effort to address the matter. If the issue remains unresolved, please reach out to the African Diurnal Safaris office to give us the chance to investigate and resolve the situation.

 

Risk

The company and its owner, director, management staff and employees shall not be held responsible for any injury or death to persons on tour, nor for loss or damage to personal property, however may they be caused. The company draws your attention to the fact that there are certain inherent risks present when on Safari, or when engaging in any strenuous physical activity.

You are solely responsible for seeking proper medical advice regarding medications, vaccinations, and assessing your fitness to undertake the trip before your departure. The company will not be held accountable for any illness, injury, or fatality that may occur while visiting properties owned or managed by the company.

 

Authority on Tour

The guide or driver assigned by the company will have the final authority on all decisions during the tour. Additionally, clients are required to adhere to the laws, customs, and foreign exchange regulations of all countries they visit at all times.

 

Animal Interactions

t African Diurnal Safaris, we are committed to fostering ethical and responsible travel experiences. We strongly stand against any form of human interaction with wild animals or support for establishments that promote or facilitate such activities.

 

Access

We cannot be held responsible for road and airstrip conditions, which may make travel impossible at times. Any changes to the initial itinerary are subject to the conditions and rates outlined above, despite any access matters or weather conditions.

 

Preventing Sexual Exploitation

At African Diurnal Safaris, we are passionately dedicated to promoting responsible tourism and combating exploitation in all its forms. Our mission includes raising awareness about various types of exploitation and harassment, with a special focus on addressing commercial and sexual exploitation, particularly involving children and adolescents.

Sexual exploitation is a pervasive global problem that often evades attention. Tackling this issue demands collective effort. We urge all our travelers to stay alert and report any suspected instances of child sexual exploitation directly to African Diurnal Safaris. Your vigilance and proactive steps can play a vital role in effecting change. Together, we can strive for travel experiences that are safer, more ethical, and rooted in respect for everyone.

 

Forbidden And Illegal Souvenirs

At African Diurnal Safaris, we maintain a strict policy against the purchase, sale, or transport of prohibited souvenirs. This includes items crafted from ivory, rhinoceros horns, hippopotamus teeth, animal tusks, horns, feathers, or skins of any game animal. Similarly, manufactured items made from these materialssuch as teeth, tusks, horns, bones, claws, hooves, hair, feathers, eggs, or other long-lasting animal-derived components—are strictly banned.

Moreover, we do not condone the trade or transport of souvenirs involving endangered plant and animal species, illegally acquired historical or archaeological artifacts, or restricted substances (including drugs or alcohol), regardless of whether they are legal in the destination country or the traveler’s home country. By upholding these principles, we strive to foster responsible and ethical tourism practices.
